NASCAR LEGAL: NA$CAR $ETTLES LAWSUIT

Grumpy’s note: You had to know that this case would never see the court room. We don’t know what this deal cost NA$CAR, yet. Something tells me that an ‘insider’ will spill the beans soon.

Here is the story from David Poole and the Charlotte Observer:

A $225 million discrimination lawsuit filed by former NASCAR Nationwide Series official Mauricia Grant has been settled in mediation, with both sides agreeing not to discuss publicly the details of the case or terms of the settlement going forward.

The settlement was announced late Thursday in a three-paragraph statement from NASCAR. The mediation was held in New York on Dec. 3, two days before this year’s Sprint Cup Awards ceremony.

Neither NASCAR nor Grant, who filed her suit in U.S. District Court for the Southern District of New York on June 10, admits liability or wrongdoing by way of the settlement, the statement said.

“We’re glad to have the case settled on mutually acceptable terms,” said NASCAR Managing Director of Corporate Communications Ramsey Poston. “NASCAR remains dedicated to maintaining a professional work environment for all employees at all times and we wish Ms. Grant well in her future endeavors.”

Grant, an Atlanta resident. was hired by NASCAR in January 2005 and was the first black woman to serve as a NASCAR official. Her lawsuit named at least 23 fellow officials and alleged a pattern of comments and behavior that created a hostile work environment. She also alleged that she was unlawfully terminated.

Grant alleged that co-workers, all white men, resorted daily to racist stereotypes in her presence and that she was called derogatory names at various times during her employment. She also charged that co-workers used racial slurs in her presence, and made suggestive remarks and unwanted sexual advances and that at least twice male officials exposed themselves in her presence.

Grant said she complained about the work environment to supervisors and was ultimately dismissed because of those complaints. NASCAR said she did not follow proceedures in reporting her charges under the company’s diversity policies and that she was fired for poor job performance.

NASCAR conducted its own investigation into Grant’s claims and eventually suspended and then fired two of the men named in the suit.

  1. Let me see if I have this straight, she asks for 225 million (as opposed to the normal 2-3 mil in this type suit) and her Shyster declares she’s been out of work all this time and in a not-so-shocking development she needed “closure.”

    As I said from the get-go she aided and abetted those that did her wrong by her own actions and was looking to cash in.

    Well, she did. But I suspect something around the 1-2 mil figure simply because all the bluster, all the “Shysterese” in the legal complaint was just that.

    Bluster and unprovable.

    And guess what Marcia? You’re still unemployed and will remain that way for the foreseeable future for the simple reason – your Toxic.

    As one who has witnessed similar incidents in the business world over my career, I have learned one important fact:

    It ain’t harassement until the victim (usually female) gets mad. As long as everybody is laughin and grab assin’ it is all good.

    I knew NA$CAR would never let this thing get to a court room. They fired at least 2 who admitted to have participated in activities that were alledged. There was not much for NA$CAR suits to do but make her an offer she couldn’t refuse.

    She better have got enough to retire on. You are correct to say she is ‘Toxic’.

  3. Given her history, one that includes restraining orders filed against her and arrests for drunk driving, she has shown me nothing to indicate her cash cow will last past the first con-artist that gets ahold of her.
